SFM Conseil proactively assists and advises its clients on competition law issues relating to mergers and acquisitions within the meaning of the Moroccan Law on Freedom of Pricing and Competition.
SFM Conseil analyzes the reputation of merger projects entrusted to it, based on regulatory criteria and conditions.
SFM Conseil assists its clients of putting the Moroccan Competition Council (Conseil de la Concurrence) on notice with respect to proposed mergers and acquisitions.
It is specified that the obligation to notify may be incumbent on any natural or legal person who acquires control of all or part of a company, or on all the parties concerned in the event of a corporate merger or the creation of a joint venture.
SFM Conseil can assist with the preparation and follow-up of merger filings with the Moroccan Competition Council (Conseil de la Concurrence):
- Preparing, drawing up and filing notices with the Moroccan Competition Council
- participating in hearings
- Monitoring operations until the minutes of the Moroccan Competition Council's decisions have been obtained.
SFM Conseil's multi-disciplinary team has already carried out a number of merger filings on behalf of domestic businesses over the past five years, helping clients to address the challenges posed by the Law on Freedom of Pricing and Competition and avoid financial penalties as a result.
